The Gist
We, Passionate Management Pty Ltd, provide Update Records with Forms through JetSubmit.com.
Update Records with Forms lets authorised HighLevel users turn CRM records into secure, pre-filled forms that can be used to view, create or update authorised HighLevel records.
You remain responsible for your HighLevel account, your CRM data, the forms you create and who receives them. We provide the software that connects those forms to HighLevel.
By installing or using Update Records with Forms, you agree to these Terms.
1. Who you are contracting with
Update Records with Forms is provided by:
Passionate Management Pty Ltd
PO Box 197
Noosa Heads, QLD 4567
Australia
Email: support@jetsubmit.com
JetSubmit is the website we are using for this service.
These Terms are intended for business users worldwide. The Service is not intended for personal, household or consumer use.
You must be at least 18 years old to install or use the Service.
2. Installing the Service
By installing Update Records with Forms, you accept these Terms.
If you install the Service for a company, agency, organisation or other entity, you warrant that you have authority to accept these Terms on its behalf.
You are responsible for ensuring that the information provided during installation is accurate and that your use of HighLevel and Update Records with Forms is authorised and lawful.
3. What the Service does
Update Records with Forms allows authorised HighLevel users to generate secure forms connected to HighLevel records.
Depending on the configuration, a form may:
- display existing CRM information;
- allow selected fields to be edited;
- hide or make fields read-only;
- require selected fields;
- accept authorised file uploads;
- update an existing record;
- create a new Contact, Business, Opportunity or supported Custom Object record;
- trigger HighLevel workflow activity; or
- redirect the recipient after submission.
We continually improve the Service and may add, change or remove features over time.
We welcome feedback, feature requests and suggestions. You agree that we may use feedback you provide without restriction or compensation to you.
4. Your CRM data
Your CRM data remains yours.
HighLevel remains the source of truth for CRM record information.
Update Records with Forms does not maintain a duplicate database of your CRM field values or submitted form contents.
The Service retrieves authorised information from HighLevel when required to display and validate a form and sends authorised changes back to HighLevel.
We do not maintain a historical copy of what someone entered into a form and cannot provide the Service as a backup or recovery system for submitted CRM field values.
You remain responsible for maintaining any backup, recovery or record-retention arrangements you require within HighLevel or elsewhere.
Our handling of personal information is also governed by our Privacy Policy, which forms part of these Terms.
5. Data processing
Where applicable privacy laws distinguish between a business controlling personal information and a service provider processing it, you remain responsible for determining the purposes for which your CRM information is collected and used.
We process that information only as reasonably necessary to provide, secure, maintain and support Update Records with Forms, including acting on the instructions you give through your configuration and use of the Service.
We will:
- use reasonable technical and organisational safeguards;
- restrict access to people and service providers who reasonably need it;
- use subprocessors where reasonably necessary to operate the Service;
- process CRM information for the purpose of providing the Service rather than building a separate CRM dataset; and
- handle deletion and retention in accordance with our Privacy Policy and applicable law.
You are responsible for ensuring you have a lawful basis and any necessary permissions to place personal information in HighLevel, expose it through a form and allow it to be created or changed.
6. Secure form links
Generated form links are access credentials.
Anyone with a valid, active form URL may potentially use the permissions associated with that form.
You are responsible for:
- deciding who should receive a form;
- protecting and distributing form URLs appropriately;
- ensuring the recipient is authorised to see any pre-filled information;
- selecting appropriate Visible, Hidden, Read-only and Required fields; and
- choosing a suitable expiry and submission configuration.
We are not responsible for loss or disclosure caused by you or another person sending, forwarding, publishing or otherwise exposing an active form URL to an unintended recipient.
Active form links cannot currently be manually revoked individually.
Every link has an expiry. A link configured for a single successful submission also becomes unusable after that submission.
7. Record changes and concurrent editing
For normal updates, Update Records with Forms sends back only fields actually changed through the form.
This reduces unnecessary overwriting when other people are working on the same HighLevel record.
If two people change different fields, both changes can generally survive.
If two people change the same field, the most recent successful save determines the resulting value.
You accept that concurrent editing can therefore affect CRM records and remain responsible for reviewing important CRM information.
8. Files
Where the Service permits file uploads, you must not upload malware, malicious code, unlawful material or material you are not authorised to process.
We may reject files based on security, file type, size or other technical requirements.
HighLevel is the destination for authorised CRM file content. Update Records with Forms is not intended to operate as a separate long-term file storage service.
9. Pricing
Update Records with Forms is currently available at the following developer prices:
- US$15 per month per HighLevel sub-account
- US$150 per year per HighLevel sub-account
- US$499 one-time Lifetime plan per HighLevel sub-account
We may withdraw the Lifetime plan from sale at any time for new purchases.
Removing the Lifetime plan from sale does not by itself cancel an existing valid Lifetime plan.
For these Terms, Lifetime means access for the lifetime of the Update Records with Forms Service, subject to these Terms. It does not mean your lifetime or guarantee that the Service will operate indefinitely.
HighLevel processes Marketplace payments and may allow agencies to resell Marketplace apps or apply their own markup. Any agency markup is separate from our developer price and is outside our control.
Applicable GST, VAT, sales tax or similar taxes may be calculated, collected or handled by HighLevel, a reselling agency or another payment participant according to the Marketplace billing arrangement that applies to the purchase.
Existing subscription pricing
Our policy is to grandfather the developer price of an active monthly or annual subscription while that subscription remains continuously active.
If HighLevel changes its Marketplace functionality or requires an existing subscription to migrate to another pricing arrangement, we may need to follow those requirements. Where reasonably practicable, we will give at least 30 days' notice before a material pricing change affects an existing subscription.
If a subscription is cancelled and later restarted, the pricing available at the time of the new subscription applies.
10. Free trial
Eligible installations may receive a 14-day free trial through the HighLevel Marketplace.
HighLevel's Marketplace systems and rules determine trial eligibility and administration.
Unless cancelled before the end of the trial, the selected recurring subscription automatically begins when the trial ends, and HighLevel processes the applicable charge.
No payment is due to us directly during a valid free trial.
11. Billing, renewals and plan changes
Monthly and annual subscriptions renew automatically until cancelled.
HighLevel manages Marketplace billing, renewals, payment collection and payment-failure handling.
Where HighLevel permits a change between subscription plans during a billing period, HighLevel may apply prorated billing adjustments according to its Marketplace rules.
If a Marketplace payment fails, HighLevel's applicable Marketplace billing process governs continued access and payment retries.
We do not independently store or process your Marketplace payment card details.
12. Cancellation and refunds
You may cancel a recurring subscription at any time through the HighLevel Marketplace.
Unless HighLevel's Marketplace process provides otherwise, cancellation stops future renewals, and access continues until the end of the period already paid for.
Unused portions of a subscription period are not refundable simply because you stop using the Service or cancel before the end of that period.
Because HighLevel processes Marketplace payments, its applicable refund policy and mandatory legal requirements also apply and may provide rights that these Terms cannot exclude.
In particular, refund requests processed through the Marketplace are subject to HighLevel's then-current Marketplace refund rules.
One-time Lifetime purchases are also subject to HighLevel's applicable Marketplace refund rules and any rights that cannot legally be excluded.
Nothing in these Terms removes any refund, remedy or consumer guarantee that cannot lawfully be excluded.
13. Fair use
Use the Service responsibly.
You must not:
- use it for unlawful, fraudulent, deceptive or malicious purposes;
- attempt to gain access to another person's HighLevel account, location or records without authority;
- interfere with the operation or security of the Service;
- bypass access controls, rate limits or security measures;
- introduce malware or malicious code;
- scrape or excessively automate access outside supported functionality;
- probe, scan or test our systems for vulnerabilities without written permission;
- reverse engineer the Service except where applicable law expressly permits it; or
- use the Service in a way that creates unreasonable risk for us, HighLevel, other users or our infrastructure.
We may rate-limit, restrict or suspend activity reasonably believed to create a security, availability or abuse risk.
14. Your responsibilities
You remain responsible for:
- your HighLevel account and users;
- the accuracy and legality of your CRM information;
- determining which records and fields a form may expose;
- ensuring recipients are authorised to access that information;
- the configuration of your forms and workflows;
- information entered by form recipients;
- reviewing important record changes;
- protecting your HighLevel credentials and secure form URLs;
- maintaining appropriate backups;
- complying with privacy, spam, data protection and other laws applying to your business; and
- promptly telling us if you reasonably believe your JetSubmit installation or a secure form link has been compromised.
You are also responsible for any downstream action caused by your HighLevel configuration, including workflows, automations, messages or other processes triggered after a form submission.
15. HighLevel and other third-party services
Update Records with Forms depends on HighLevel's APIs, infrastructure and Marketplace.
HighLevel is a separate service that we do not control.
We cannot guarantee:
- HighLevel uptime;
- continued availability of particular HighLevel APIs;
- HighLevel data formats or behaviour;
- Marketplace billing functionality;
- API limits;
- workflow behaviour; or
- continued availability of any particular HighLevel feature.
HighLevel may change its platform at any time.
Some HighLevel workflow functionality used with Update Records with Forms, including Marketplace workflow triggers or actions, may be classified by HighLevel as premium workflow features. HighLevel may charge additional usage-based, per-execution or plan-based fees for those features separately from your Update Records with Forms subscription. HighLevel sets and controls any such charges, free allowances, pricing models, classifications, and billing arrangements, and they may change from time to time. They are outside our control and are not included in the Update Records with Forms subscription price unless we expressly state otherwise.
We may modify Update Records with Forms as reasonably necessary to respond to changes made by HighLevel or another service we depend on.
Your use of HighLevel remains subject to your separate agreement with HighLevel.
16. Availability and support
We aim to provide a reliable Service but do not guarantee uninterrupted or error-free availability.
The Service may be unavailable because of maintenance, upgrades, security work, internet failures, cloud infrastructure issues, HighLevel outages, API changes, or events outside our reasonable control.
Support is available through:
- online chat;
- WhatsApp;
- support@jetsubmit.com; and
- the support phone number published with the Service or its Marketplace listing.
Unless separately agreed in writing, we do not provide contractual uptime, response-time or service-level guarantees.
17. New and changing features
We expect Update Records with Forms to evolve.
We may release new functionality as we develop it. Features may change as we learn from customer use and feedback.
We may improve, modify, replace or remove parts of the Service.
If a change is materially detrimental to existing users, we will provide reasonable advance notice where practicable.
We may implement security fixes, legal requirements, HighLevel platform changes, and urgent operational changes without advance notice.
18. Suspension
We may suspend some or all access to the Service where reasonably necessary because of:
- non-payment;
- suspected fraud;
- unlawful activity;
- material breach of these Terms;
- security risks;
- misuse or abuse;
- risk to another customer;
- risk to HighLevel or our infrastructure; or
- a requirement imposed by law or a third-party platform on which the Service depends.
Where practical, we will try to resolve the underlying issue with you.
19. Termination
You may stop using the Service and cancel your subscription at any time.
We may terminate your access without cause by giving you at least 60 days' notice.
If we terminate without cause, existing forms may continue operating during that 60-day notice period unless maintaining them would create a security, legal or third-party platform risk.
We may terminate or suspend access immediately where there is a serious breach, fraud, unlawful conduct, deliberate abuse, a significant security threat or conduct that creates material risk to us, HighLevel or other users.
Where termination is immediate, active forms may stop working immediately.
After termination, we retain and clean up operational information in accordance with our Privacy Policy and legal obligations.
20. Intellectual property
Update Records with Forms, JetSubmit, our software, documentation, designs, branding and underlying technology belong to Passionate Management Pty Ltd or our licensors.
These Terms do not transfer ownership of that intellectual property to you.
You retain ownership of your CRM information and content.
You may use the Service for your internal business purposes while you have a valid right to access it under these Terms.
You may not copy, sell, sublicense or commercially exploit our software except through functionality we expressly provide.
HighLevel and other third-party names and trademarks belong to their respective owners.
21. Marketing
We will not use your business name, logo or trademarks to publicly identify you as a customer without your separate express permission.
22. Service communications
We may send communications reasonably necessary to provide and administer the Service, including security notices, billing-related information, trial notices, material service changes and important account information.
Marketing communications are separate and will be sent in accordance with applicable consent and unsubscribe requirements.
23. Liability
We provide the Service in good faith, but software and third-party platforms sometimes fail.
To the extent permitted by law, the Service is provided on an as-available basis without a guarantee that it will always be uninterrupted, error-free or suitable for every particular business purpose.
We are not responsible for loss caused by matters outside our reasonable control, including:
- HighLevel outages, defects or API behaviour;
- another third-party service;
- incorrect CRM information;
- incorrect object, record or form configuration;
- inappropriate field visibility;
- a secure link being sent to the wrong person;
- information entered incorrectly by a recipient;
- another person changing the same CRM record;
- workflows or automations configured by you;
- failure to maintain appropriate backups; or
- your failure to protect credentials or secure links.
To the extent permitted by law, we are not liable for indirect or consequential loss, loss of profit, loss of revenue, loss of opportunity, loss of goodwill or similar economic loss arising from use of the Service.
To the maximum extent permitted by law, our total aggregate liability arising from or connected with the Service or these Terms is limited to the amount of fees actually paid for the affected sub-account during the six months immediately preceding the event giving rise to the claim.
Nothing in these Terms excludes, restricts or modifies any liability, right, guarantee or remedy that cannot lawfully be excluded, restricted or modified, including applicable rights under the Australian Consumer Law.
24. Indemnity
To the extent permitted by law, you indemnify Passionate Management Pty Ltd against third-party claims, liabilities and reasonable costs directly arising from:
- your unlawful use of the Service;
- your material breach of these Terms;
- your unauthorised disclosure of another person's personal information through a form; or
- your use of CRM information where you did not have authority to access or process that information.
This indemnity does not apply to the extent the claim was caused by our own negligence, wilful misconduct or breach of these Terms.
25. Changes to these Terms
We may update these Terms as the Service, law or HighLevel platform changes.
We will give at least 30 days' notice of material changes where reasonably practicable.
Changes reasonably necessary to address security threats, legal requirements or urgent third-party platform changes may take effect sooner.
Your continued use of the Service after updated Terms take effect constitutes acceptance of those Terms.
If you do not accept a material change, you may stop using the Service and cancel your subscription before the change takes effect.
26. Assignment
We may assign or transfer these Terms, or any rights and obligations under them, without your consent as part of a sale, restructure, merger, financing, transfer of the JetSubmit business or other corporate transaction.
You may not assign or transfer your rights under these Terms without our prior written consent.
27. Events outside our control
Neither party is responsible for failure or delay caused by events outside its reasonable control.
For us, this may include natural disasters, fire, flood, internet or telecommunications failures, cloud infrastructure outages, cyber incidents, government action, changes in law, industrial disputes and failures or changes affecting HighLevel or another necessary third-party platform.
This does not excuse an obligation to pay amounts already due.
28. Australian Consumer Law
Update Records with Forms is offered as a business service.
However, some business customers may still have rights under the Australian Consumer Law or other legislation that cannot be excluded by contract.
Nothing in these Terms is intended to exclude those rights.
Where the law allows liability for a failure to comply with a statutory guarantee to be limited, our liability is limited, at our option, to supplying the relevant services again or paying the reasonable cost of having those services supplied again.
29. Marketplace terms
Your installation or purchase of Update Records with Forms through the HighLevel Marketplace may also be subject to HighLevel's applicable Marketplace terms, billing rules, refund policies and platform requirements.
Those rules govern matters controlled by HighLevel, including Marketplace payment processing.
If there is an inconsistency between these Terms and a mandatory HighLevel Marketplace rule concerning a transaction processed by HighLevel, the HighLevel rule applies to that Marketplace-controlled matter.
These Terms continue to apply to your relationship with Passionate Management Pty Ltd and your use of Update Records with Forms.
30. General
These Terms and our Privacy Policy form the agreement between you and Passionate Management Pty Ltd concerning Update Records with Forms, together with any separate written agreement expressly agreed between us.
If part of these Terms is unenforceable, the remaining provisions continue to apply.
A failure to enforce a provision immediately does not waive the right to enforce it later.
Headings are for convenience and do not change the meaning of these Terms.
31. Governing law
These Terms are governed by the laws of Queensland, Australia, without regard to conflict-of-law rules.
You and Passionate Management Pty Ltd submit to the jurisdiction of the courts of Queensland and the courts of the Commonwealth of Australia having jurisdiction in Queensland.
